Description of Claims
The Law Offices of Cynthia N. Sass, P.A., represents a class of firefighters in an arbitration against Wackenhut Services, LLC. The firefighters allege that Wackenhut Services, LLC, failed to pay them for all hours worked or failed to compensate them for all firefighting and other services provided to Wackenhut Services, LLC, in Iraq.

In the Class Action against Wackenhut, John Grabowski and 26 other firefighters represent all employees hired by Wackenhut Services, LLC, before February 27, 2006, as "firefighters" who were subject to an Employment Agreement to perform firefighting and other services in Iraq. On February 12, 2008, the Arbitrator issued an order in which she confirmed that the class includes fire chiefs and assistant chiefs, as well as firefighters, lieutenants, and captains or crew chiefs.

The case is pending before JAMS, which is a company that provides arbitration services. In arbitration, the Arbitrator renders a decision at the end of an arbitration hearing. That decision is final and binding on all parties, including members of a certified class who have not asked to be excluded, subject only to a very limited court review. In other words, the Arbitrator will make a final decision regarding who will win this arbitration (instead of a court or a jury deciding who will win). And if the firefighters win, the Arbitator will also decide how much money or other relief the firefighters will receive. Arbitrator Joan C. Grafstein, Esquire, is the Arbitrator on the matter.

Wackenhut Services, LLC, has stated that it will not retaliate against any employee or former employee for his or her involvement in the class action arbitration.

Decisions and Documents Filed
On May 11, 2007, Arbitrator Joan Grafstein decided that the Wackenhut Services, LLC, Employment Agreement permits the arbitration to proceed on behalf of a class.

On July 27, 2007, the Class Representatives filed a Fourth Amended Demand for Arbitration with JAMS.

On August 16, 2007, Arbitrator Joan Grafstein granted the Class Representatives' motion for class certification, approving a class of all employees hired by Wackenhut Services, LLC, before February 27, 2006, as "firefighters" who were subject to an Employment Agreement to perform firefighting and other services in Iraq.

The Arbitrator has issued a scheduling order in this matter outlining deadline dates and procedures.
