EEO-1 Reporting Requirements--Title VII

Title VII of the Civil Rights Act of 1964 was passed to eliminate discrimination on the basis of race, sex, national origin, color, and religion from the American workplace. Title VII, which applies to most employers with 15 or more employees, is enforced by the Equal Employment Opportunity Commission (EEOC). To facilitate its enforcement of Title VII, the EEOC has promulgated regulations subjecting covered employers to several reporting requirements. This article summarizes the requirement of the EEO-1 form, the main report required under Title VII.

Before September 30 of every year, the following categories of employers are required to file an EEO-1 report with the EEOC:

* Private employers subject to Title VII with 100 or more employees

* Private employers subject to Title VII with fewer than 100 employees, where the employer is owned by or affiliated with another company that has 100 or more employees

In addition, non-exempt federal contractors with 50 or more employees are required to file EEO-1s if they:

* Are prime contractors or first-tier subcontractors, and have a contract, subcontract, or purchase order amounting to $50,000 or more, or

* Serve as a depository of Government funds, or

* Are a financial institution that is an issuing and paying agent for U.S. Savings Bonds and Notes.

Only entities located in the 50 states or in the District of Columbia are required to file EEO-1 forms. Furthermore, state and local governments, school systems, and educational institutions are exempt from EEO-1 requirements.

The EEO-1, which may be filed electronically, requires employers to report the number of employees that fall into each of five racial categories. It also requires employers to specify the number of male and female employees. Finally, the report requires employers to report the number of employees, broken down by race and sex, who fall into each of the following categories:

* Officers and managers

* Professionals

* Technicians

* Sales workers

* Office and clerical

* Craft workers (skilled)

* Operatives (semi-skilled)

* Laborers (unskilled)

* Service Workers

The information reported to the EEOC through the EEO-1 remains confidential. It is not made available to the general public, except in an aggregated non-identifiable form.

Persons filing false EEO-1 reports may be subject to fines or imprisonment.
