Cynthia Sass is coordinating the How to Prepare and Win and/or Defend a Single Plaintiff Discrimination Suit: Top 20 Tips from an Associate’s Perspective (Fundamentals) section of the 11th Annual Labor and Employment Law Section Conference of the American Bar Association this November.  She has lined up Stephanie Jones from the EEOC as moderator, as well as the 3-person panel of Sarah Fask from Littler Mendelson P.C., Lucas Kaster from Nichols Kaster, PLPP and Brianna Primozic from Posner & Rosen LLP.  The panel will discuss the most effective way to handle a single plaintiff case and share valuable lessons that they have learned in the trenches. The panelists will also discuss tactics that minimize hours spent in preparing and trying a case, discovery tips, summary judgment preparation and overall strategies that work and don’t work.

Yvette Everhart spoke to Dr. Charmaine Rose’s Saint Leo University students at the downtown Tampa campus on Thursday, June 1, 2017.  Ms. Everhart discussed some of the most common types of employer discrimination, harassment and abuse, as well as the resources available to employees.

April 28, 2017 – Cynthia Sass was scheduled to speak with Amanda Maisels of the U.S. Department of Justice and Eve Hill of Brown, Goldstein & Levy, LLP, at the 2017 Advanced Labor & Employment Topics course in Key West, Florida, sponsored by the American Bar Association Commission on Disability Rights in conjunction with the Labor and Employment Law Section and the CLE Committee of The Florida Bar, on the topic Beyond Employment: ADA Compliance on Websites and Physical Access.  Although she was unable to attend in person, Ms. Sass contributed to the presentation and submitted a white paper entitled Website Accessibility for Individuals with Disabilities for use by the attendees.

February 15, 2017 – Cynthia Sass presented at the webinar ADA and Website Accessibility sponsored by the Labor & Employment Law Section of The Florida Bar.  The program addressed what happens when websites and apps are inaccessible and discussed the new wave of litigation developing under Titles II and III of the Americans with Disabilities Act attacking the accessibility of the public websites of private companies and public/government agencies. Amanda Maisels, Deputy Chief of the Disability Rights Section discussed how the DOJ has pursued enforcement actions and regulatory development focused on making websites that are place of public accommodation and, most recently, mobile applications accessible to individuals with disabilities. These developments span virtually all major industries, including, among others: retail, real estate, hospitality and lodging, finance, sports/entertainment, and academia. The three-person panel discussed the differing court views on accessibility and the ADA, as well as cases the DOJ has brought; website accessibility litigation against business entities in the private sector; and Kara Noreika of AccSass Consulting, LLC, provided information as to the technical aspects and steps necessary for websites and apps to meet the current compliance standards.

January 27, 2017 – Cynthia Sass spoke at the 17th Labor and Employment Law Annual Update and Certification Review sponsored by The Florida Bar’s Labor & Employment Law Section and Continuing Legal Education Committee.  Ms. Sass spoke on the topic of EEO – Procedural.  Ms. Sass discussed procedural prerequisites and administrative exhaustion schemes that apply to most federal and state employment discrimination statutes which are critical for attorneys practicing in the area of employment discrimination law. Understanding these procedures assist in avoiding dismissal, whereas defense practitioners need this knowledge to eliminate and/or reduce their clients’ risk of civil liability.  Ms. Sass also focused on the similarities and differences that exist under the statutes containing these procedural prerequisites and administrative exhaustion requirements prior to bringing suit.

January 18, 2017 – Cynthia Sass spoke at the 16th Annual Employment Law: Rights, Benefits, and Emerging Issues seminar in Tampa hosted by Sterling Education Services.  Her topic was Florida specific and she addressed Workplace Challenges of Privacy, Social Media, and Technology Issues.  Ms. Sass discussed the various laws and regulations which address these quickly evolving issues.

November 9-12, 2016 – Cynthia Sass spoke at the 10th Annual Conference of the Labor & Employment Section of the American Bar Association in Chicago last November.  She discussed Getting and Returning to Work: Fitness for Duty Exams and Related Legal Issues from a plaintiff employee’s perspective.  The panel addressed the fine line between ensuring a safe and productive workplace while maintaining the legal, medical and privacy rights of employees and job applicants, as well as exploring the legal boundaries of fitness-for-duty exams and how they can be implemented to ensure workplace safety while safeguarding employee rights.

October 17, 2016 – Cynthia Sass and Yvette Everhart spoke at the meeting of the Sandspur Chapter of FICPA in Tampa.  Ms. Sass addressed the emerging issue of website compliance under the Americans with Disabilities Act, and Ms. Everhart discussed the new wage and hour law which affects salaried employees.

April 26, 2016 – Yvette Everhart presented at the live webinar entitled Litigation Holds in Employment Lawsuits: Creating an Early and Effective Plan for Collecting and Preserving ESI, sponsored by Strafford Publications, Inc.  The webinar was directed at labor and employment attorneys and the panel discussed recurring discovery and common records subject to preservation in employment actions and offered solutions for creating a litigation readiness and document preservation plan to avoid potentially costly spoliation allegations and sanctions under the new Federal Rule of Civil Procedure 37(e).
