November 12, 2020 – Ms. Everhart moderated and participated in a panel discussion on Everything Employers and Employees (and their Counsel) Need to Know About Electronic Communication Policies and Social Media at the virtual 14th Annual Section of Labor and Employment Law Conference sponsored by the American Bar Association in November. The panel will discuss a variety of issues related to the use of personal electronic devices for work, tweets, email searches and posts on personal social media accounts.

March 2020 – Yvette Everhart moderated a segment on practicing before the Florida Department of Economic Opportunity—Reemployment Assistance, the agency responsible for administering unemployment benefits at the Practice Before State Labor & Employment Agencies seminar scheduled for March 2020 in Tallahassee. The seminar was sponsored by the Labor and Employment Law Section of The Florida Bar. Yvette was among several distinguished speakers at this event.

February 8, 2020 – Cynthia Sass spoke on the topic The Intersection of Employment Law and Criminal Law at the College of Labor and Employment Lawyers Regional Programming Committee event in St. Petersburg, Florida. Cynthia’s presentation provided practitioners with guidance on how to identify and handle employee and employer criminal activity in the workplace, such as claims of employee theft or embezzlement, employees viewing pornography on employer’s devices and employer’s illegal activity such as fraud on the government. She also discussed best practices and ethical considerations for addressing these issues.

Cynthia Sass was to participate in a panel discussion on The Impact of AI, Automation and Robotics in the Workplace at the Midwinter Meeting of the Employment Rights & Responsibilities Committee of the American Bar Association in Puerto Rico which was postponed due to the pandemic. The panel plans to focus on how automation, AI, and robotics’ performance of worker tasks raise significant questions about workplace transition and employee dislocation, and address what stakeholders should focus on to capitalize on opportunities and to meet the challenges to come.

Cynthia Sass joined the Lawyers for the Arts program, which is an Ad Hoc Board Committee of the Tampa Museum of Art. The Lawyers for the Arts program is specifically designed to help local attorneys learn about the most recent and significant case law impacting the art world. The Tampa Museum’s Executive Director, Michael Tomor, established this program and Ms. Sass is honored to be a part of it.

Cynthia Sass wrote a chapter about Discovery and Deposing the Alleged Harasser and Defense Witnesses: Plaintiff’s Perspective for a new TIPS book, Sexual Harassment and Retaliation: A Practical Guide for Plaintiff and Defense, released in April 2019 by the Tort Trial & Insurance Practice Section of the American Bar Association. With sexual harassment and retaliation claims on the rise, the book offers critical background and best practices for attorneys representing both Plaintiff Employees and Defendant Employers to successfully litigate these difficult claims.

November 8, 2019 – Yvette Everhart moderated and participated in the panel discussion Who is Entitled to Protection from Retaliation? (Fundamentals), at the 13th Annual Section Conference this November sponsored by the Section of Labor and Employment Law of the American Bar Association. The panelists discussed the growth of third-party retaliation claims since the Thompson decision in 2011 and how courts are determining which type of co-employee relationships are sufficient to allow third-party retaliation claims to proceed. A comparison of the analysis of third-party claims under Title VII and anti-retaliation provisions of other labor laws such as the FLSA were also included.

October 17, 2019 – Cynthia Sass and her fellow panelists discussed First Amendment in Public Employment at the 45th Annual Public Employment Labor Relations Forum in Orlando. June 28, 2019 – Janet Wise spoke at the NELA convention in New Orleans. The topic of her panel presentation was Does the Opposition Clause Have Only Selective Application? Defendants’ Use of the Manager Rule to Limit Retaliation Claims. Ms. Wise discussed the current law in the Eleventh Circuit on this topic and how best to deal with arguments employers make related thereto.

November 7, 2018 – Cynthia Sass was honored to be part of the program, A View from the Bench: I Wish I Didn’t Know Now What I Didn’t Know Then, presented at the 12th Annual ABA Section of Labor and Employment Law Conference in San Francisco, California. Ms. Sass joined Judge Waverly Crenshaw, Judge Elizabeth LaPorte and Judge Rebecca Pallmeyer, along with her co-Moderator Sean Gallagher, as the judges discussed the lessons they have learned on the bench and how they would apply those lessons to the practice of employment litigation.

PRESERVING WITNESS TESTIMONY
September 14, 2018 – Cynthia Sass co-presented with Alicia Koepke of Trenam Kemker, at the Effectively Litigating Employment Cases from Inception Through Trial program sponsored by the Labor and Employment Law Section of The Florida Bar. Ms. Koepke and Ms. Sass discussed Where’s the Witness? Preserving Witness Testimony Through Trial and provided insight into ways to preserve a witness’s testimony early in the process through statements, video, and depositions, as well as effective and ethical methods for deposition preparation. Then they offered some effective methods to convert the witness testimony into evidence at both the summary judgment and trial stages.

The webinar was directed at labor and employment attorneys and the panel discussed recurring discovery and common records subject to preservation in employment actions and offered solutions for creating a litigation readiness and document preservation plan to avoid potentially costly spoliation allegations and sanctions under the new Federal Rule of Civil Procedure 37(e).

June 27, 2014 – Cynthia traveled to Boston this summer and was the moderator for the panel that discussed the volatile topic of Social Media, Employer Surveillance and Employee Privacy, as well as a speaker, at the National Employment Lawyers Association 2014 Annual Convention titled Blazing the Trail: Courage | Challenge | Change.


May 2014 – Yvette Everhart’s article, Navigating Ethical Perils of Social Media Surveillance, was published on page 66 in the May 2014 issue of the Hillsborough County Bar Association’s LAWYER magazine. The article discusses what lawyers can and cannot do using social media.

April 23, 2014 – Cynthia Sass spoke at the Workers’ Compensation Section of the Hillsborough County Bar Association CLE luncheon. Ms. Sass discussed common employment and labor laws that may come into play in a worker’s compensation case.

November 10, 2011 – Cynthia Sass addressed members of the Plant City Bar Association. She discussed the current laws related to employment cases as outlined in her handout, General Practitioners Beware! Employment Claims You Should Know About.
November 5, 2011 – Cynthia Sass braved the elements during November on her trip to Seattle, Washington, to participate in a panel discussion appropriately named Rainmaking Tips in an Economically Challenging Environment at the Fifth Annual American Bar Association Labor & Employment Law Conference. This panel was part of the Leadership Development track and Ms. Sass’ presentation was entitled RAINMAKNG: The Art of Increasing Business for Your Law Firm.
October 27, 2011 – Janet Wise addressed the State Bar of Georgia and the Georgia Chapter of the National Employment Lawyers Association seminar, Tips for Litigating Plaintiffs’ Employment Cases, in Atlanta. Her topic of discussion was Professionalism and Avoidance of Sanctions.
September 9 – 11, 2011 – As Florida NELA’s Vice President of Programming, Yvette Everhart finished coordinating its 2011 Summer Conference at the Don CeSar Hotel on St. Pete Beach. The theme for the weekend was Clear Skies and Smooth Sailing for Employment Law Cases. Ms. Everhart arranged for several judges to speak as well as other special guests. It was an informative and fun weekend.
September 9, 2011 – Cynthia Sass presented at the 2011 Florida NELA Summer Conference, Clear Skies and Smooth Sailing for Employment Law Cases. Her discussion was based on the topic, Valuing a Case.
August 23, 2011 – Cynthia Sass spoke at the Sterling Education Services, Inc.’s Employment Law Update: Contemporary Challenges in a Changing Workplace seminar on the topic, Privacy and Social Media in the Workplace. This topic is of interest to both employees and employers as it deals with current issues in the electronic workplace.
July 1, 2011 – Cynthia Sass spoke to members of the National Employment Lawyers Association in New Orleans at their Annual Convention. Her topic was Shaping Your Client’s Expectations from Intake to Settlement.
June 10, 2011 – Cynthia Sass also spoke in June and presented The Rise of the Machines: Discovery and Spoliation Issues in This Age of Technology to the attendees at the Advanced Labor Topics seminar. This event was sponsored by the Labor and Employment Law Section of The Florida Bar.
April 29, 2011 – As a member of the Technology in the Practice and Workplace Committee of the American Bar Association’s Labor & Employment Law Section, Cynthia Sass handled the topic, Discovery and Subpoenas for the Next Generation of Workplace Technology, at the National Symposium on Technology in Labor and Employment Law in New York City.
